EMERGENCY ROADSIDE ASSISTANCE

Part 1. TRAFFIC COURT DEFENSE – Club will pay up to $100.00 to member’s attorney for defending member in court on traffic ticket. Benefit can be used once per calendar year per membership account.

Part 2. LEGAL FEES - Club will pay attorney of member’s choice a fee up to $100.00 to prosecute case in behalf of member for personal injuries sustained in traffic accident. An additional fee of up to $100.00 will be paid to member’s attorney to prosecute a claim for damages sustained to member’s automobile as a result of a traffic accident. In each situation it is reasonable presumed a third party is guilty of negligence in causing damage to member. Benefit can be used only once per calendar year per membership account.

Part 3. EMERGENCY SERVICE – Member has a choice of calling 24-hour dispatch for which member signs up to a maximum benefit ($75.00) or member may call for road service of choice and Club will reimburse member up to maximum benefit ($75.00). Club will pay or reimburse for towing or wrecker service and service call by garage or mechanic to member’s disabled auto. Included is opening locked vehicle, ignition or garage door if member’s key has been lost or broken. Emergency roadside service includes labor and service call only up to a maximum benefit ($75.00). Gas, parts, new keys and repairs in garage or at service station are not included, except tire repair and battery charge which are limited to $15 each. Only one wrecker charge and service call per disablement. Assistance of private citizen or services of a family member in wrecker business not reimbursable.

Part 4. EMERGENCY AMBULENCE EXPENSE – Club will reimburse member up to $150.00 for transportation of member by an emergency medical transportation vehicle to a medical facility from the scene of a traffic accident in which member is injured.

Part 5. EMERGENCY TRAVEL EXPENSE – If member is more than 100 miles from home and his or her automobile becomes disabled, Club will reimburse member up to $300.00 in actual expense of continuing journey by car rental or commercial transportation and/or room and board while waiting on auto repairs. If master member and associate member are traveling together this benefit is limited to $300.00. If disabling event occurs where member is temporarily employed, benefit limited to transportation expense only.

Part 6. MAP SERVICE – Within 15 days of receiving requests, Club will send member marked maps giving the most direct or time-saving route from member’s home to destination anywhere in the continental United States or Canada.

Part 7. WORLD-WIDE TRAVEL SERVICE – If member would like to have the services of a professional travel agent for advice and information about tours or cruises, or need help in the purchase of tickets and making reservations, Motor Club members are urged to contact Travel II, Inc. This independent agent has agreed to give priority service and best possible prices to Club members. Club receives no monetary consideration from your use of travel agents services.

Part 8. BUMPER DECAL FOR MEMBER’S AUTOMOBILE – Members will receive a card which is proof of membership in the Club and in addition members will receive a distinctive emblem for placement on member’s automobile. In addition to denoting membership in the Club, the emblem demonstrates Club member’s support of safe driving.

Part 9. DEFINTIONS – The following definitions are applicable

Automobile – Any motorized or horse-drawn non-commercial vehicle legally used to transport humans on highways of any state in the U.S.A. or province of Canada. Off-road, all-terrain, RV/Campers and human-powered machines are specifically excluded. Fleet vehicles excluded if not personally operated by member.

Master Member - Individual who pays full membership fees and is listed in the Club’s files as an active member.

Associate Member(s) – Individual(s) (up to 4 adults) who is/are occupant(s) of a Master member’s household and is/are listed in files of Club in conjunction with an active Master member.

Associate member receives full benefits of membership except when traveling with master member over 100 miles from domicile.

Part 10. DISABLEMENTS – A Disablement is defined as dispatch of Emergency roadside service following a call to the 24/7 Emergency Dispatch center. Membership benefits include four (4) Disablements per year per membership account.

Part 11. EXCEPTIONS – Benefits of membership will not be paid if incident giving rise to claim occurs while member: (a) is intoxicated, or under the influence of a drug or narcotic, (b) is charged with illegally leaving the scene of an accident, (c) is charged with no or improper license or permit, or, (d) is charged with operating overweight or over-length vehicle.

Part 12. CLAIMS – For claim services send written requests for benefit, giving membership number and include paid receipts. Club may require completion of claim report or any reasonable proof of claim legitimacy such as receipts, repair statements, accident reports, medical reports, toxicology reports, or affidavits. All claims and proofs of loss must be submitted within ninety (90) days of incident giving rise to claim. Mail claims directly to Club which promise courteous, prompt, and fair treatment.

Part 13. CANCELLATION – Member may cancel membership on notice with full refund of fees less any claims paid, within thirty (30) days of application. Club may refuse or cancel membership at any time with or without cause. If cancelled after thirty (30) days by Club or member, refund will be made on a pro-rated basis, over the period of the contract without and deduction.

Part 14, AGENT – The company or individual authorized to sell memberships is authorized to receive fee refunds to member’s credit. Other than issue this certificate no statements or assurances by agents or agent’s employees shall be binding upon Club.

Part 15. CHANGES – These benefits, limitations and exceptions pertain to membership in Club issued after the date hereof. Club may change benefits, limitations and exceptions upon notice to member.
